Justice Fiberesima of the Oyibo division of the Rivers State High Court on Monday said the court lacks the jurisdiction to entertain the suit seeking to stop the ongoing impeachment proceedings by the Rivers State House of Assembly ,as the matter is already before the Appeal Court.
The Rivers State House of Assembly and the Chief Judge of the state approached the appeal court to give interpretation to section 188 (10) of the constitution of the Federal Republic of Nigeria, 1999 as amended.
Justice Fiberesima said it is beyond the powers of the state high court to hear a matter that is already before an appellate court.
The court therefore adjourned indefinitely , pending the decision of the appeal court .
The appeal court is expected to give clarification on the position of the constitution, whether or not the state high court or any other court can interfere or stop an ongoing impeachment proceeding.
